Terms of Service

These terms are short on purpose. They cover the PocketChomp Android app, PocketChomp+ and this website. By using any of them you agree to what is written here.
1. Who we are
PocketChomp is built and operated by Josh Del Vecchio, an independent developer in Ontario, Canada ("we", "us"). Contact: josh@pocketchomp.com.
2. Who can use PocketChomp
You must be at least 18 years old to use PocketChomp.
3. Not medical advice
PocketChomp is a logging tool, not a healthcare provider. Calorie targets, expenditure estimates, nutrient values and any insight the app shows are estimates based on public food data and standard formulas. They are for general information only.
Talk to a doctor or registered dietitian before changing your diet, especially if you are pregnant, under 18, managing a medical condition, or have a history of disordered eating. Do not rely on the app for medical decisions, allergen information, or nutrition claims on packaged products. Mindful mode hides calories but does not replace professional support.
4. The free app and PocketChomp+
The core app is free, with no ads. PocketChomp+ ("Plus") is an optional subscription that unlocks additional features described in the app and on this site. We may change which features are free and which are Plus, but we will not move the basic logging loop (search, barcode and label scanning, custom foods, the diary and micronutrient tracking) behind the paywall.
Billing
- Plus is billed through Google Play at the price shown there. New subscribers get a 14-day free trial unless Google Play states otherwise.
- Subscriptions renew automatically until you cancel. Cancel any time in Google Play under Subscriptions. Cancelling stops the next renewal and does not refund the current period.
- Refunds follow the Google Play refund policy. Contact us if you have a problem and we will help where we can.
- Deleting your PocketChomp account does not cancel a Google Play subscription. You must cancel it in Google Play.
- We may change Plus pricing with notice in the app or by email. Changes apply from your next renewal.
5. Accounts
An account is optional. If you create one, keep your email account and Google account secure, since they are how you sign in. You are responsible for activity under your account. One account per person, please. You can delete your account at any time. See the account deletion page.
6. Your data
Your food logs, custom foods, recipes and other entries are yours. You keep all rights to them. You give us permission to store, process and transmit them only as needed to run the app and its features (for example, syncing them to your other devices or generating a CSV export). How we handle data is set out in the Privacy Policy, which forms part of these terms.
7. Food data and accuracy
The food database combines the Health Canada Canadian Nutrient File, the USDA FoodData Central tables, Open Food Facts (available under the Open Database License), and nutrition information published by Canadian retailers for their products. Trademarks and product names belong to their owners and are used only to identify foods.
Nutrition data can be wrong, outdated or incomplete. Manufacturers change recipes, and scanned labels can contain mistakes. Always check the package if it matters.
8. AI features
Photo logging and recipe import use an AI model to identify foods and estimate portions and nutrition. These are best guesses and can be wrong. Review every result before you log it. AI features need an internet connection and may be rate-limited or changed as costs and models change.
9. Health Connect
Connecting Health Connect is optional. Activity and weight data read from it feeds estimates only. You can revoke access in Android at any time.
10. Acceptable use
Please do not:
- reverse-engineer, scrape or bulk-download the food database or our servers;
- use the app to build a competing dataset or service;
- abuse Plus features, rate limits or the trial (for example with repeated accounts);
- upload content you do not have the right to share, or that is unlawful or harmful;
- interfere with other users or with the service.
11. Our content
The app, the website, the PocketChomp name and logo, and our own code and design are ours and protected by copyright and trademark law. We give you a personal, non-transferable licence to use the app on your Android devices. That licence ends if you break these terms. Open-source components inside the app are covered by their own licences, listed in the app under About.
12. Beta and availability
PocketChomp is in beta. Features may change, break, or be removed, and servers may be unavailable. Keep your own exports if your data matters to you. We can suspend or end the service, or your access to it, with reasonable notice where practical, and immediately if you break these terms.
13. Disclaimer and limitation of liability
The app and website are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of data. To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for any loss arising from reliance on nutrition data, estimates or AI output. Our total liability to you for any claim is limited to the amount you paid us for Plus in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited under the laws of your province, including Ontario consumer protection law.
14. Changes to these terms
We may update these terms. The date at the top shows the current version. For material changes we will notify you in the app or by email before they take effect. Continuing to use PocketChomp after that means you accept the new terms.
15. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes will be handled in the courts of Ontario, unless consumer law where you live gives you the right to go elsewhere.
